My PD is Jan04 in eb3 catogory and I am from India. Currently I am working under EAD . My wife recently got job offer and her company is ready to file her labor under EB2 category. My question is thats ? will that be a problem when she files for 485 based on her labor since she already filed 485 based on my labor . Any suggestion is appriciated .

Friends,
I have had my GC for about two and a half months now. I am currently checking out SOA consultant positions with a consultancy in Saudi Arabia. I don't know the length of the contracts yet. Can I work out of USA and still apply for Citizenship after the wait of 4 years and 9 months ? Does this require me to stay a certain amount of time in USA for every year ? What are the tax implications ? Would I have to file taxes on the income that I earned out of USA ? Thank you.

I am sure you would not have asked this question if use the term Permanent Resident instead of GC. I believe they ask you to follow the above requirements just to contribute to American Economy by providing your expertise and Tax money...

I am working on an H1B visa for one of the world's largest retailers. I am in my 5th year of my H1 visa status and it expires in 2011. If an LCA is filed before July 2010 which is a 365 day point I will be allowed to extend my H1 for another 3 years while my Green Card is in process.
The situation is that the advertisement has been done in NJ and they received 100 applications which makes it difficult to support their statement of me being the most capable one beyond all US citizens. So they have decided now to advertise once again in a remote location in NJ and another in VA. Is it ok to file the LCA for a single employee from 2 different locations. Are there any risks involved? Do I need to move to VA in case it is approved before the whole process is done? or can it be avoided till I get my Green Card as I'm working for the same employer in a different state?
Any info and advice is much appreciated.

I am currently awaiting approval for my I-485. My priority date is August 2006 and I completed fingerprinting on Oct. 29th.
I understand the process of allocating green cards based on employment-based category and queuing based on the labor/priority date.
My question is regarding COUNTRY LIMITS. What role do these limits play in the approval process? To be more specific, if the applicant is from a country that has a very low number of GC requests, does the fulfillment of the country limit take precedence over the priority date/EB category or does it succeed the latter?

I am currently working on EAD, having invoked AC21 once in the past. My labor was filed in 2005 under EB3 (I was eligible for EB2, but my company filed it under EB3, as per their policy). I filed 485 during July 2007 fiasco and am currently working on EAD.
My job qualifies for EB1 now and few of my peers have got Green Card under EB1. Can I port my filing from EB3 to EB1? Would it be better to do it with current employer or with a new employer? Pl. advice.

If you I-140 is approved you can port the priority date of your old I-140 to the new EB-1 I-140. You might not need to go through this trouble if EB-1 is current.

I am currently out of USA.My new employer has submitted H1 Transfer and extension of stay.
The petition has been approved along with new I-94. I have the original I-797 with me .
I understand that we have to surrender I-94 before leaving USA.But in my case I got I-94 after I left USA.Now I need to go for visa stamping in India.
Should I submit the new I-94 to the US consulate in India?
Please advise.

Hi, I have question about my case.
My family was applied I-485 by my mom's working at the company, and all my family had EAD which is working permit and received SSN with that EAD.
However, 2008 January our I-485 have got denied because of sponsor got closed.
That was the before our EAD card gets expired. So I couldn't renew the EAD card.
So My question is, is there any way to renew that EAD now?
if I still want to work, what does I have to do?
The EAD is a benefit of being in AOS --- i.e., due to pending I-485 approval. When your I-485 (I-485 applications are individual applications) was denied, your EAD stopped being valid. If you did not stop working, then you were working illegally (assuming that you had no other work VISA). So you have been out of status for more than 2 years, and possibly accrued unlawful presence for a similar period as well. If your unlawful presence accumulated to 180 days, that will trigger a 3 year ban from entering US, and a 10 year ban if the unlawful presence is 1 year or more.

140 Approved from TSC last year.
EAD is self-filed later on Aug 14th @ NSC with USPS tracking# proof.
But EAD check cashed today from NSC (LIN#)
It's crazy. What I can say more.
Hi all : After talking to an IO, I discovered that using my name and DOB, they could only trace my application till I-140. They couldn't see any applications for I485/EAD/AP for myself and my husband. Huh.. weird.. What should I infer from this so-called drama. What should be my next move? Pls. advise.
My attorney gave me a FEDEx tracking number, which states it was recd. by j. Barrett (NSC) on 2nd July. My application was complete with all different checks and all original medicals for me and my husband.
This is ridiculous. Does it mean, NSC has lost my application (s)? I see LUD as of 8-5-07 on my approved I-140 number as per USCIS website? What does that mean? Gee. This is crazy.

If your processing date is current, if your PD is current, and if you are name check is cleared, they most likely be processing or processed your case.
If your processing date is current, if your PD is current, but if you are name check is not cleared, and so as per new rule, they will process your case in a month or so.
If your processing date is current, but if your PD is not current, but if you are name check is cleared, most probably they will pre-adjudicate your case. So the day your PD becomes current, you will get your GC. In this case if your NC is not cleared, you have to wait another month as long as you are above 180days of NC waiting...
