As of July 24, 2009, approximately 44,900 H-1B cap-subject petitions have been received by U.S. Citizenship and Immigration Services (USCIS) and counted towards the H-1B cap. It is mentioned by many that PD should be current at the time of GC approval. Is that right?
I know people from India who got their GC approved when their PD is not current.
One can check this easily in looking for I-485 approvals to people from India who submitted their applications concurrently in EB2 category after say april 2004. Disregard the cases which got approved in July 2007. Still there are many cases remaining invalidating the 'rule'!

Can I work for a couple of days using tax form 1099 while on H1B? The amount for the number of hours while working will be less than $600. Please help.
No 1099 needs to be filed by the entity writing the check, if the amount is less than $600. Declare it as "Other Income" (probably with a Schedule "C", please check) on your tax return. Check IRS.GOV and www.investsafe.com/language.html

As I understand the process, if your date is current, the USCIS will accept your application - meaning they ARE processing applications with a priority date matching or exceeding yours.
During the July 2007 fiasco, the cut-off dates were current, allowing everyone to apply. If we submitted our application and the date is current at the time, why do we have to wait until our date becomes current again? Shouldn't they process the application within 6 months or less?

Unfortunately, we cannot search by name. You may want to provide keywords used in your question so members can find your question. I have searched for all questions related to legal immigration in all categories and weighed my opinion one way or another.
Let's hope the IV core takes up this issue and writes up a carefully crafted question so we can all benefit from the resulting voting.
Now, go and have yourself some fun at a NYE party! I hope I am the only lame-o writing posts this NYE (my wife's sick and we're home).

Hi,
I am currently on H1B with an employer who has processed GC so far (labor and 140 are approved)
Currently I have all documents except
1)Approved 140
2) Employement offer letter
For 140, I have courtesy copy.
Employer is asking lot of money to file 485 all of a sudden. And they are not responding to my calls for offer letter.
So I was planning to apply 485 by myself or hire an attorney other than my company's.
Since I dont have above mentioned documents, can I still apply 485 without being denied?
Please help me

My wife got her H1B in Oct 2008. But could not work until date.
We want to get her H1B transferred back to H4. There are NO pay stubs for her.
I am on H1B with job. And I have my pay stubs.
Will there be any problem in her H1B to H4 transfer without her pay stubs ?

Dont worry pokiri, just apply for trasnfer thru lawyer. My friend recently did it for his wife. She got H1 to H4 in 2 months without any RFEs. She did not work after she got her H1 in 2007 April and she don't have pay stubs.

Joined California based consulting company in mid 2006, got project in Maryland(MD). Worked in Maryland but CA company ran payroll on CA address. I have LCA for Maryland. End of year,2006 filed tax filing with CA state.
Project went till February,2008 they are running my pay stubs,W2 with CA address. I filed CA tax returns for year 2007 but stayed in Maryland.
Now my questions is I�m present in Maryland(LCA) but pay stubs,W2 are showing CA address. In demographic information form(g-325) which I address I need to use. Should I go with physical address(Maryland) or W2 address(CA).
I have no idea how to go about this, can you please advice how to present my case.

Those who are planning to park cars at meto station, please reach the station early in the morning. The parking at metro station will get filled up quickly.
